Terms of Service

These terms govern your use of Qualifinder.io, operated by E-Flex Digital LLC ("we", "us"). By creating an account or using the service, you agree to them. The text messaging terms also apply to anyone who texts a phone number that uses our service.

The service

Qualifinder.io gives real estate professionals a phone number to publish on their listings. When someone texts that number, the service replies on the professional's behalf using artificial intelligence, answers questions about the listing and collects details such as the person's timeline and financing, so the professional can follow up.

Text messaging terms

• Program: real estate professionals using Qualifinder.io reply by text to people asking about their property listings.
• Opt-in: you opt in by texting a listing's phone number. We only reply to people who text first, and only about the listing they asked about.
• Message frequency varies based on your conversation.
• Message and data rates may apply.
• Opt-out: reply STOP at any time to stop receiving messages. You'll get one message confirming you've opted out.
• Help: reply HELP for help, or email support@qualifinder.io.
• Carriers are not liable for delayed or undelivered messages.
• See our Privacy Policy for how we handle your information. We don't share mobile information with third parties for marketing.

Accounts

You must be at least 18 and able to form a binding contract to create an account. You're responsible for keeping your login secure and for everything that happens under your account. Keep your account and business information accurate and up to date.

Text message registration

US carriers require businesses to register before sending text messages. You authorize us to register your business with Twilio, mobile carriers and The Campaign Registry using the information you provide, and you confirm that information is accurate and belongs to you or your business. Carriers decide whether to approve a registration, and we can't guarantee approval or how long it takes.

Your responsibilities

You agree to:

• Comply with all laws that apply to your messaging, including the Telephone Consumer Protection Act, CAN-SPAM, state telemarketing laws and carrier and CTIA guidelines.
• Use the service only to respond to people who contact you about your listings, and not to send unsolicited, marketing or bulk messages.
• Only publish listings you're authorized to market, with accurate information.
• Honor opt-out requests, and not contact people who have opted out through other means.
• Not use the service for anything unlawful, harassing, deceptive or discriminatory, including anything that violates fair housing laws.

We may suspend messaging or your account if your use violates these terms, the law or carrier rules, or puts the service at risk.

AI-generated replies

Replies are written by artificial intelligence based on your listing information and the conversation. They can be incomplete or wrong. You're responsible for the accuracy of your listing information and for reviewing your conversations. Replies are not legal, financial or professional advice.

Subscriptions and billing

Paid plans are billed in advance on a recurring basis through Stripe until you cancel. You can cancel anytime from your billing settings, and cancellation takes effect at the end of the current billing period. Except where the law requires otherwise, payments are non-refundable. We may change prices with advance notice; changes apply from your next billing period.

Your content

You keep ownership of the listings, messages and other content you provide. You give us permission to use it as needed to run and improve the service. The service itself, including our software and branding, belongs to us.

Termination

You can delete your account at any time from your account settings. We may suspend or end your access if you breach these terms. Sections that by their nature should survive termination, such as disclaimers and limits of liability, will survive.

Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that messages will be delivered, that the service will be uninterrupted or error-free, or that it will produce any particular result, such as leads or sales.

Limitation of liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.

Indemnification

You agree to defend and indemnify us against claims arising from your use of the service, your content or your violation of these terms or the law, including claims about messages sent on your behalf.

Governing law

These terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws rules.

Changes to these terms

We may update these terms from time to time. If we make material changes, we'll update the effective date above and notify customers by email. Continuing to use the service after changes take effect means you accept them.
